Understanding Train Delay Compensation in the UK

What Is Delay Repay?

Delay Repay is the compensation scheme used by most UK train operators. It entitles you to money back when your train arrives late at your destination, regardless of the reason for the delay. This is important — unlike flight compensation, you do not need to prove the train company was at fault. Bad weather, signal failures, staff shortages — it does not matter. If your train was late, you can claim. The standard thresholds are 25% back for delays of 15–29 minutes (offered by some operators), 50% for 30–59 minutes, and 100% for delays of 60 minutes or more. Cancellations always qualify for a full refund of your ticket cost.

Automatic vs Manual Claims

Some operators now offer automatic Delay Repay, where compensation is paid into your account without you needing to do anything. LNER, for example, can automatically detect when a journey linked to your account was delayed and credit you. However, most operators still require you to submit a manual claim through their website. You typically need your ticket details, the date and time of travel, and sometimes a photo of your ticket. Season ticket holders can also claim — your refund is calculated as a proportion of the daily cost of your season ticket.

Your Legal Rights Under the Consumer Rights Act

Beyond Delay Repay, the Consumer Rights Act 2015 gives you the right to a service performed with reasonable care and skill. If a train company consistently fails to deliver the service you paid for, you may have additional grounds for complaint. The National Rail Conditions of Travel also set out your rights, including the right to a full refund if you choose not to travel because of disruption. If your Delay Repay claim is rejected and you believe you are entitled to compensation, you can escalate to the Rail Ombudsman. This is a free, independent service that can make binding decisions. The ombudsman typically resolves cases within 40 working days and can award compensation beyond the basic Delay Repay amount if the operator handled your complaint poorly.
